Husband of Judith McAllister, Gospel Music Artist and COGIC Music Dept. President, Has Been Indicted For Fraud

Judith McAllister’s husband, who is a Nashville based FBI special agent, has been charged with fraud in connection with a mortgage scheme.

A news release from the U.S. Attorney’s office in East Tennessee is reporting that Darin Lee McAllister faces a total of 19 counts, including wire fraud and bank fraud.If convicted on all counts, McAllister faces a total of 345
years in prison and $6.5 million in fines.

Press Release-FOR IMMEDIATE RELEASE, Thursday, May 20, 2010, :
Darin Lee McAllister, a Special Agent employed by the Federal Bureau of Investigation in Nashville, Tennessee, was indicted yesterday by a grand jury sitting in Nashville, Tennessee. This indictment was announced by United States AttorneyJames R. Dedrick, United States Attorney for the Eastern District of Tennessee, who is sitting by designation in the Middle District of Tennessee

The 19 count indictment charges McAllister, 44, of Brentwood, Tennessee, with wire fraud in violation of Title 18, United States Code, Section 1343, bank fraud in violation of Title 18, United States Code, Section 1344 and swearing a false oath in bankruptcy in violation of Title 18, United States Code, Section 152(3). The indictment alleges the defendant devised a wire fraud scheme to defraud SunTrust Mortgage Co., Inc., in connection with the purchase of rental properties totaling $1.25 million in May and July 2006. In addition, the indictment charges the defendant with devising a scheme to defraud the SunTrust Bank in connection with a $100,000 line of credit and making three false statements in connection with his subsequent bankruptcy petition in July 2009

If convicted on all counts, McAllister faces a total of 345 years in prison and $6.5 million in fines. The maximum penalty for each violation of the wire fraud statute is 20 years in prison and a $250,00 fine. The maximum penalty for each count of bank fraud is 30 years in prison and a $1million fine. The maximum penalty for each count of swearing a false oath is 5 years in prison and a $250,000 fine. Each count also carries a mandatory $100 special assessment. The court may also order restitution to any victims of the fraud.

McAllister will appear in United States District Court in Nashville, Tennessee, on June 9, 2010. He will be permitted to surrender himself to the United States Marshals.

This investigation was conducted by Office of the Inspector General, United States Department of Justice, with the assistance of the United States Bankruptcy Trustee’s Offices in Chattanooga and Nashville. Assistant U.S. Attorney Gary S. Humble represents the United States.

The public is reminded that an indictment is a form of accusation and is not evidence of guilt. The defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.

    I pray for the the McCallister family in this issue, I also feel that its “TERRIBLE” to post a picture of Judith McCallister concerning this.

    This is a heartbreaking blow to the Gospel music industry because Judith has not been named in this indictment, she is only associated because of her husband. This could bring room for misinformation. Judith is a worshipper and praise leader and a very influential figure in the body of christ.

    Moreover, this is a credible source for Gospel Music information. I am appauled that this article was published this way. This is a place where there should be support and clarity for Judith, not magnifying or promoting this challenge in her life. Don’t throw our sister under the bus on this!

    Remove her picture, post an appology and never let it happen again!!!!!!

    It is too bad that God has to be insulted by those who serve him. It is very unfortunate that this has happened but, I pray that Bro Darin is not guilty of the statements that I have read. As Christians we are not exempted if we live for God with our hearts, and our deeds or otherwise, and we mix with wrong doings as the world does, we have to suffer as the sinner who does not confess to be saved. Remember a life goes with our quoting scriptures, we must not be as or do as the world does. We are in the world but we should not be conformed to this world, that is scripture.

    The difference with the sinner as to a christian is, one does not confess to know Christ in thier lives, but the saved person has Jesus as his advocate. Our lives still should be different with our confessing Christ in our lives.

    The scripture states”A mind stayed on Christ stays in perfect peace”- not greed.

    I believe that God is in control and that we need to pray for our sister and her family. God is able and will do exceeding and abundantly above all of which we ask or think according to the power that worketh in us. It is more than time for the saints to pray and stop the plans of the enemy.

    I am in agreement with Aaron. It is unfortunate and unfair that a picture of Judith McAllister was posted. She is not mentioned in the article as doing anything wrong. Yet you post her picture as if she was indicted as well! Evang. McAllister deserves an apology from this site. That is the Godly thing to do! Use wisdom in the future as you report the news concerning the gospel!

    I think this is totally and completely embarrassing that this article would be published on this sight. This is supposed to be a place to come and read “gospel” news and updates etc…It’s obvious that the person who published this has no idea whatsoever what “gospel is defined as. It simply means GOOD NEWS. So when you have a site like this there should be good reports and messages of love and hope, for God sakes this is one of the most powerful tools for soul winning…why use it to air the dirty laundry of gospel artists as such as Mrs McAllister husband. That is her personal life and it should have been left up the the United States District Attorney office to place this mess in the eyesight of the public…but most certainly not a GOSPEL website. This is awful that this would be done to Mrs McAllister who is one of gospels greatest & most powerful songwriters…she does not deserve this public scrutiny !

    I really appreciate your comment. In this post I explained that I included the picture as a means to bring additional clarity to the story. I have tremendous respect for Judith McAllister and I pray that everything works out well.

    I want to encourage my Sister and Brother, because such we’re some of us at one point in our lives, according to 1Corinthians 6:11, I say trust in The Lord that he will vindicate your husband in this matter.
